Environmental services

I. Sewage services (CPC 9401)

Legal basis: WTO, FTAs, AFAS.

Investment conditions:

1. WTO, FTAs, AFAS: No limitation. Confirming that services supplied in the exercise of governmental authority as defined in Article I: 3 (c) may be subject to public monopolies or exclusive rights granted to private operators.

Foreign companies are allowed to do business activities in Vietnam in the form of build-operate-transfer (BOT) and build-transfer-operate (BTO).

Access to certain geographic areas may be restricted for national security reason.

2. The law of Vietnam: No regulation on investment conditions applied to foreign investors.

II. Refuse disposal services (CPC 9402)

Legal basis: WTO, FTAs, AFAS.

Investment conditions:

1. WTO, FTAs, AFAS: No limitation. Confirming that services supplied in the exercise of governmental authority as defined in Article I: 3 (c) may be subject to public monopolies or exclusive rights granted to private operators.

For the purpose of ensuring public welfare, foreign-invested enterprises are restricted from collecting refuse directly from households.

They are only permitted to provide services at the refuse collection points as specified by local municipal and provincial authorities.

Access to certain geographic areas may be restricted for national security reason.

2. The law of Vietnam: No regulation on investment conditions applied to foreign investors.

III. Cleaning services and similar services (CPC 9403)

Legal basis: AFAS.

Investment conditions:

1. WTO: Not included in the Schedule.

2. AFAS: No limitation.

Access to certain geographic areas may be restricted for national security reason.

3. The law of Vietnam: No regulation on investment conditions applied to foreign investors.

IV. Cleaning services of exhaust gases and noise abatement services (CPC 9404, 9405)

Legal basis: WTO, FTAs, AFAS.

Investment conditions:

1. WTO, FTAs, AFAS: No limitation. Confirming that services supplied in the exercise of governmental authority as defined in Article I: 3 (c) may be subject to public monopolies or exclusive rights granted to private operators.

Access to certain geographic areas may be restricted for national security reason.

V. Natural protection services (CPC 9406)

Legal basis: AFAS.

Investment conditions:

1. WTO, FTAs: Not included in the Schedule.

2. AFAS: No limitation.

VI. Environmental impact assessment services (CPC 94090*)

Legal basis: WTO, FTAs, AFAS.

Investment conditions:
